1. Overview
These Pilot Terms of Use (“Terms”) govern participation in the Clever Kit Pilot Program (“Pilot Program”), operated by Clever Kit (“Company,” “we,” “us”). By enrolling as a Pilot, you agree to these Terms.
The Pilot Program allows approved partners (“Pilots”) to promote, resell, or white‑label Clever Kit products and services, including but not limited to Clever Kit Pro, Clever Kit Validate, Clever Mail, and related tools (collectively, the “Services”).
2. Pilot Eligibility & Account Responsibilities
- Pilots must be at least 18 years old and legally able to enter contracts.
- Pilots are responsible for maintaining accurate account information.
- You are responsible for all activity conducted through your Pilot account, including actions taken by your clients.
3. Independent Contractor Status
Pilots are independent contractors. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship.
4. Permitted Use
Pilots may:
- Promote Clever Kit services to end users
- Onboard clients via approved links, magic links, or integrations
- Access Pilot dashboards, analytics, and tools provided by Clever Kit
Pilots may not:
- Provide legal advice
- Guarantee credit score increases or deletions
- Misrepresent Clever Kit services
- Alter, reverse‑engineer, or misuse the platform
5. No Legal Advice / No Guarantees
Clever Kit is not a law firm and does not provide legal advice. All letters, workflows, and AI‑generated outputs are for informational purposes only.
Credit outcomes vary. Clever Kit makes no guarantees regarding deletions, score increases, or financial outcomes.
6. AI‑Generated Content Disclaimer
Pilots acknowledge that Clever Kit uses artificial intelligence to generate dispute letters and analysis. Outputs may require human review and are not substitutes for professional advice.
7. Third‑Party Services
The Services may integrate with third parties, including credit monitoring providers, mailing providers, and payment processors. Clever Kit is not responsible for third‑party systems, outages, or decisions.
8. Compliance & Consumer Protection
Pilots must comply with all applicable laws, including but not limited to:
- Credit Repair Organizations Act (CROA)
- Fair Credit Reporting Act (FCRA)
- State consumer protection laws
Pilots are solely responsible for their own marketing compliance.
9. Fees, Commissions & Payments
- Pilot commissions, pricing, and fees are governed by separate agreements or dashboards
- Clever Kit may modify commission structures with notice
- Abuse, fraud, or chargeback activity may result in forfeiture of commissions
10. Termination
Clever Kit may suspend or terminate Pilot access at any time for violations, misuse, or compliance risk.
Pilots may terminate participation at any time by discontinuing use of the Services.
11. Limitation of Liability
To the maximum extent permitted by law, Clever Kit shall not be liable for indirect, incidental, or consequential damages.
12. Indemnification
Pilots agree to indemnify and hold harmless Clever Kit from claims arising out of Pilot conduct, marketing, or client interactions.
13. Governing Law
These Terms are governed by the laws of the United States and the state designated by Clever Kit.
